This policy applies to information we collect:

  • On our websites and in your registration for the Patriot Steps Challenge (collectively, the “Sites”).
  • In email, text and other electronic messages between you and the Sites.

  • DHS through any other means, other than through our Sites, including on any other website operated by any third party (including our affiliates and subsidiaries); or
  • Any third party (including our affiliates and subsidiaries), including through any application or content (including advertising) that may link to or be accessible from or on the Site.

By “personal information,” we mean data that is unique to an individual, such as a name, address, Social Security number, e-mail address, or telephone number. From time to time, we may request personal information from you at our Sites in order to deliver requested materials to you, respond to your questions, deliver a product or service, or register for the Challenge or another contest.

COLLECTING AND USING PERSONAL INFORMATION

When you visit, navigate, or register with our Sites and when you communicate with us via our Sites, we will not collect personal information about you unless you provide us with that information voluntarily. As you use the Sites, DHS may ask you for certain information, including but not limited to your name, email address, postal address, and telephone number. Such information is provided voluntarily by you. In general, however, you can visit the Sites without telling us who you are or revealing any personal information about yourself.

We use information that we collect about you or that you provide to us, including any personal information:

  • To provide you with information, products, or services that you request from us.
  • To provide you with notices about your communications with us.
  • To carry out our obligations and enforce our rights arising from your use of the Sites.
  • To present the Sites and its contents to you.
  • To notify you about changes to the Sites or any products or services we offer or provide through it.
  • To allow you to register and participate in the Challenge or other contests.
  • To allow you to participate in interactive features on the Sites.

SHARING

DHS will not sell, license, transmit or disclose your personal information outside of DHS and its affiliated companies except (a) as expressly authorized by you; (b) as necessary to enable DHS contractors or agents to perform certain functions for us; (c) as required or permitted by law; (d) to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of DHS assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which personal information held by DHS about the Sites’ users and registrants is among the assets transferred; (e) to fulfill the purpose for which you provide it; (f) to our promotional partners to provide you with information that we think may be of interest of you; (g) for any other purpose disclosed by us when you provide the information; and (h) with your consent. In all cases, we will disclose the information consistent with applicable laws and regulations and we will require the recipient to protect the information and use it only for the purpose it was provided.

We may also disclose your personal information for the following reasons: (i) to comply with any court order, law or legal process, including to respond to any government or regulatory request; (ii) to enforce or apply our terms of use, the official rules of the Challenge, and other agreements; and (iii) If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of DHS, our customers, or others.

We may disclose aggregated, non-personal information about the Sites’ users without restriction.

 

COOKIES AND ONLINE TRACKING TECHNOLOGIES

DHS and our partners may use automatic data collection technologies such as cookies to collect non-personally identifiable information when you visit the Sites, including but not limited to the type of browser you are using, the type of operating system you are using, your IP address, aggregate data about the number of visits to the Sites, and aggregate data about the pages visited, but in doing so we do not connect this information with your personal information such as your name or email address to personally identify you. DHS does not collect user personally identifiable information over time and across third-party websites, and we do not permit third parties to gather information passively on the Sites for behavioral advertising purposes.

You can control many tracking tools, including cookies, from your browser. In particular, you may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of the Sites. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to the Sites.

Additionally, some Internet browsers have a ‘do not track’ feature that lets you tell websites that you do not want to have your online activities tracked. These features are not yet uniform, so we are currently not set up to respond to such signals.

 

LINKING TO OTHER SITES

From time to time, DHS’s Sites may provide links to other websites, not owned or controlled by DHS, that we think might be useful or of interest to you. We cannot, however, be responsible for the privacy practices used by other website owners or the content or accuracy of those other websites. Links to various non-DHS websites do not constitute or imply endorsement by DHS of these websites, any products or services described on these Sites, or of any other material contained in them.

 

SECURITY

DHS has adopted and adheres to stringent security standards designed to protect non-public personal information against accidental or unauthorized access or disclosure. Among the safeguards that DHS has developed for the Sites are administrative, physical and technical barriers that together form a protective firewall around the information stored at this site. Nevertheless, such security measures may not prevent all loss, misuse, or alteration of information on the Sites, and DHS is not responsible for any damages or liabilities relating to any such security failures. By using the Sites, you understand that there is a risk that data and communications, including email and other electronic communications, may be accessed by unauthorized third parties. The foregoing does not affect any liability that cannot be excluded or limited under applicable law.

 

UPDATING YOUR INFORMATION

In some cases and in all cases where required by law or regulation, you will be able to update the information that you provide to us either by sending us an e-mail or, where you have established personal profiles with us, by updating your profile online. Please refer to the specific pages where data is collected for more information.

 

OPT-OUT PROCEDURES

If you do not wish to have your contact information used by DHS as noted in this Policy, you can opt out by contacting us at info@dhsgroup.com.

If we have sent you a promotional email, you may send us a return email asking to be omitted from future promotional email distributions. This opt-out does not apply to transactional emails regarding your transactions or updates to our policies.

 

YOUR CALIFORNIA PRIVACY RIGHTS

Under California law, a California resident with whom DHS has an established relationship has the right to request certain information with respect to any personal information DHS may have shared with third parties for their direct marketing purposes, and the identities of those third parties, within the immediately preceding calendar year, subject to certain exceptions. In response to a written request, DHS is allowed to provide a cost-free means to opt out of such sharing.

Since DHS does not provide your personal information to third parties for their direct marketing purposes, it is not necessary for us to establish this procedure; however, if you do not want DHS to use your personal information to promote our products or services please follow the cost-free opt-out procedures in this policy.

 

TRANSFER OF INFORMATION TO THE UNITED STATES

The Sites are operated in the United States and is intended for users located in the United States. If you are located outside the United States, please be aware that information we collect, including personal information, may be transferred to, processed, and stored in the United States. By using the Sites or providing us with any information, you consent to the transfer, processing, and storage of your information in the United States. You are also consenting to the application of United States federal and Texas state law in all matters concerning the Sites and this Privacy Policy.

 

INFORMATION ABOUT CHILDREN

The Sites are not directed to children under the age of 18 years. We will not request personally identifiable information from anyone whom we know to be under the age of 18. By using the Sites, you represent and warrant that you are at least 18 years old. If we become aware that a customer is under the age of 18 and has registered or otherwise provided personally identifiable information, we will cancel the corresponding registration and remove his or her personally identifiable information. Those under 18 may use the site for education reasons with parent or guardian permission.

 

CHANGES TO OUR PRIVACY POLICY

DHS may change this statement from time to time; when updates are made, the privacy policy version date (located at the bottom of this policy) will also be updated to reflect that a revision occurred. We encourage you to periodically reread this policy to see if there have been any changes that may affect you. Continued use of the Sites following any changes or modifications to this Policy shall be deemed as your acceptance of any changes in the terms of the Privacy Policy.
